EL RECONOCIMIENTO DE LA RESPONSABILIDAD INTERNACIONAL POR DAÑOS AMBIENTALES TRANSFRONTERIZOS
Resumen
ResumenEn el presente artículo se pretende abordar el reconocimiento de la responsabilidad internacional por daños transfronterizo, partiendo de la concepción de la responsabilidad internacional que se produce por el incumplimiento de una obligación internacional, y el análisis del daño transfronterizo ambiental, es decir, aquellos efectos negativos en el medio ambiente que producen las actividades en la jurisdicción de un Estado en el territorio de otro Estado, como una causal para la determinación de responsabilidad internacional de un Estado.
Finalizando, con la exposición de las sanciones internacionales en las cuales se puede incurrir por la responsabilidad de daños transfronterizos ambientales dictadas en la jurisprudencia de la Corte Internacional de Justicia, siendo la sentencia con más mérito en el asunto la de Ciertas actividades realizadas por Nicaragua en la zona fronteriza (Costa Rica v. Nicaragua) en donde, por primera vez, se impone una sanción monetaria a un estado por daños transfronterizos de carácter ambiental.

Abstract
This article aims to address the recognition of international responsibility for transboundary damage, starting from the conception of international responsibility that is produced by the breach of an international obligation, and the analysis of transboundary environmental damage, that is, those negative effects on the environment that are produced by activities in the jurisdiction of a State in the territory of another State, as a ground for the determination of the international responsibility of a State.
Concluding, with the exposition of the international sanctions that can be incurred due to the responsibility for transboundary environmental damages dictated in the jurisprudence of the International Court of Justice, the sentence with the most merit in the matter being that of Certain activities carried out by Nicaragua in the border area (Costa Rica v. Nicaragua) where, for the first time, a monetary sanction is imposed on a state for transboundary environmental damage.
