CORTE INTERNACIONAL DE JUSTICIA, diferencia entre jurisdicción y admisibilidad

Resumen

La Corte Internacional de Justicia es el ente designado por las Organización de Naciones Unidas para resolver controversias entre Estados y de emitir opiniones consultivas. El Estado iniciando un proceso debe justificar la jurisdicción y admisibilidad de cada alegato.

En general, la Corte Internacional de Justicia considera que las cuestiones de jurisdicción se derivan del derecho y poder que tiene la Corte para considerar cada caso, las cuales se encuentran detalladas dentro del Artículo 36 del Estatuto de la Corte. Aunque la Corte tenga jurisdicción para conocer determinado caso, no tiene la obligación de ejercitar esa jurisdicción si no se cumple con los criterios de admisibilidad.

La admisibilidad; incluye cuestiones que podrían impedir que el Tribunal adjudique los méritos de una disputa, y determinan si llevar el caso ante la Corte es una decisión adecuada. En el presente trabajo se desarrollan el principio del oro amonedado, la validez legal y la legitimación del interés jurídico como cuestiones relativas a la admisibilidad; entre otras.

Abstract

The International Court of Justice is the entity designated by the United Nations to resolve disputes between States and issue advisory opinions. The State initiating a process must justify the jurisdiction and admissibility of each submission.

In general, the International Court of Justice considers that the questions of jurisdiction are those that derive from the right and power of the Court to consider each pleading, which can be found detailed on Article 36 of the Statute of the Court. Although the Court may have jurisdiction over a certain topic, it does not have the obligation to exercise that jurisdiction if the criteria for admissibility is not met.

Admissibility includes issues that could prevent the Court from adjudicating the merits of a dispute, it also determines whether taking the case to this Court is an appropriate decision. The Monetary Gold Principle, mootness, and standing are some issues of admissibility.
